01What this covers
This Release and Waiver of Liability and Assumption of Risk ("Waiver") applies to my participation in Sunrise Yoga and any other yoga class, session, or event led by Jessica Szabo, at Bonita Fish Company in Fort Myers Beach, Florida, or at any other location, on any date (each, an "Activity").
Jessica Szabo ("Instructor") is independently providing the yoga instruction for the Activity. Bonita Fish Company ("Venue") is the host and location of the Activity and does not provide the instruction.
02Assumption of risk
I understand that yoga is a physical activity that involves stretching, balancing, bearing weight on my joints, and holding positions, and that it carries a risk of injury, including muscle strain, sprains, falls, and in rare cases more serious injury. I understand the Activity takes place outdoors on a wooden deck beside open water, and that additional risks include uneven, wet, or slippery surfaces, weather, heat and sun exposure, insects, noise, other participants, restaurant operations nearby, and proximity to the water. I knowingly and voluntarily assume all of these risks, known and unknown, whether or not they are listed here.
03My health
I confirm that I am in good physical condition to take part, or that I have consulted a physician and been cleared to do so. I will tell the Instructor before class about any injury, pregnancy, surgery, or medical condition that could affect my participation, and I will listen to my body, modify or skip any pose, and stop if I feel pain or discomfort. I understand the Instructor is not a medical professional and that nothing said in class is medical advice.
04Release and waiver
In exchange for being allowed to participate, I release, waive, and discharge Jessica Szabo, her agents, assistants, and assigns, and Bonita Fish Company, together with their respective owners, operators, employees, agents, and affiliates (collectively, the "Released Parties"), from any and all claims, demands, losses, damages, or causes of action arising out of or related to my participation in the Activity, including injury, illness, death, or damage to my property, including claims arising from the ordinary negligence of any Released Party, to the fullest extent permitted by Florida law. This release does not apply to gross negligence or intentional misconduct, or to any liability that Florida law does not allow to be waived.
05Indemnity
I agree to indemnify and hold the Released Parties harmless from any claim, loss, or expense, including reasonable attorney's fees, arising from my own acts or omissions or my breach of this Waiver.
06One signature per person
This Waiver covers only the person named in the signature below. Every participant must buy their own ticket and sign their own Waiver. All participants must be at least 18 years old.
07Photo and video consent
I understand that photographs and/or video may be taken during the Activity for promotional, social media, and website purposes. By ticking the photo and video consent box when signing, I consent to the use of my image and likeness for these purposes without compensation. This consent is separate from the release above and can be withdrawn for future use at any time by emailing [email protected].
08General
This Waiver is governed by the laws of the State of Florida. If any part is found unenforceable, the rest remains in effect. It applies to every Activity I attend until I revoke it in writing. I am at least 18 years old. By typing my name and signing below I intend my electronic signature to be as binding as a handwritten one.
09Acknowledgment
I have read this Waiver, I understand it, and I sign it voluntarily.
